Boarding Homes Class Action

  • The Indian Boarding Homes Program was established by the Government of Canada and placed Indigenous children and teenagers in Boarding Homes, with private families, to attend school
  • The Indian Boarding Homes Class Action Settlement provides compensation to individuals that were placed in Boarding Homes by the Government of Canada
  • Indigenous Children and Teenagers that were removed from their homes and placed in Boarding Homes to attend school might be entitled to compensation between $10,000.00 and $210,000.00
  • To be eligible, the Student must have been removed from their home and placed, by the Government, in a Boarding Home between September 1, 1951, and June 30, 1992
  • Deceased’s individual’s families can apply of their family member was placed in a Boarding Home between September 1, 1951 and June 30, 1992 and passed away after July 24, 2016
  • Claimants can apply even without school or medical records, and there is no Court
  • This process is based upon and will be determined by forms and documents that are completed and then submitted to the Boarding Home Administrator
  • Claimants can have their choice of lawyer assist them, and will not be “out of pocket” for legal fees as the Government has agreed to pay the Claimant’s lawyer fees
  • Compensation is divided in to 2 categories, and based upon on the abuses experienced and the harms suffered while at the Boarding Home and range from $10,000.00 to $210,000.00
  • Claimants can be eligible for compensation for both category 1 and 2
  • Compensation for category 1 is $10,000.00 and every class member (claimant) is eligible
  • Compensation for category 2 is between $10,000.00 and $200,000.00, again, depending on the abuse experienced and harm suffered. Examples include:

  • Forced exposure to pornography
  • Nude photos taken
  • Individuals exposing themselves
  • Kissing
  • Touching genitals or private parts (directly or through clothing), fondling or kissing

One or more serious physical assault causing:

  • Serious but temporary harm (e.g. black eye, bruises, etc.)
  • Minor impairment or disfigurement that was not permanent (loss of consciousness, broken bones, damaged teeth)

Two or more incidents of abuse, such as:

  • Unreasonable confinement
  • Deprived of food, health care, adequate clothing, bedding, or heat
  • Forced consumption of alcohol, drugs or noxious substances
  • Being prevented from attending school
2c$100,000.00One incident of:

  • Masturbation
  • Oral or attempted oral intercourse
  • Attempted penetration

Recurring physical assaults causing:

  • Serious but temporary harm (e.g. black eye, bruises, etc.)
  • Minor impairment or disfigurement that was permanent (loss of consciousness, broken bones, damaged teeth)
2d$150,000.00One incident of penetration (including vaginal or anal)

Two or more incidents of:

  • Attempted oral intercourse
  • Attempted penetration

One or more physical assault causing permanent or long term impairment, injury, or disfigurement

2e$200,000.00Two or more incidents of:

  • Masturbation
  • Oral intercourse
  • Penetration (including vaginal or anal)

Any pregnancy resulting from a sexual assault

One or more physical assault that caused permanent mobility loss or brain injury
